1. Who you are contracting with
BookAppt ("the Service") is operated by BookAppt ("we", "us", "our"). By creating an account or using the Service you are entering into an agreement with BookAppt. Questions about these terms can be sent through the feedback form in the app.
2. Acceptance
By registering for, accessing or continuing to use the Service you agree to these terms. If you do not agree, do not use the Service. If you are using BookAppt on behalf of an organisation, you confirm you have authority to bind that organisation; if you are using it as an individual, you confirm you are of legal age to form a binding contract.
3. The Service
BookAppt lets you publish your availability, share a booking link, accept appointment bookings, send confirmations and reminders, and exchange messages with the people who book with you. Features may change over time as the product develops.
4. Your account
You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Access to host accounts may require approval by us.
5. Acceptable use
You must not misuse the Service. In particular, you must not:
- use it for any unlawful purpose or in breach of applicable law;
- use it for fraud, spam, harassment or unsolicited bulk messaging;
- infringe anyone's intellectual property or privacy rights;
- interfere with the security or integrity of the Service, including uploading malware, probing or scanning systems, or scraping data;
- reverse engineer the Service, resell or redistribute it, or circumvent technical or plan limits.
You are responsible for the content you and your clients submit through the Service (appointment details, addresses, phone numbers, messages) and you grant us a limited licence to host and process that content solely to provide the Service.
6. Intellectual property
We retain all ownership of the Service, including its software, design, documentation and branding. You receive a limited, non-exclusive, non-transferable right to use the Service in line with your selected plan. Your data remains yours.
7. Service level and warranties
We work to keep BookAppt available and reliable, but we do not guarantee that the Service will be uninterrupted, timely, secure or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. You remain responsible for confirming important appointments independently.
8. Payment and subscription terms
BookAppt is offered on a monthly subscription following a free trial period. Current pricing is shown on our Pricing page. Subscriptions renew automatically each month until cancelled, and you can cancel at any time from your dashboard; access continues until the end of the paid period.
Payment, billing, tax, invoicing, cancellation and refund mechanics are governed by Paddle's Buyer Terms. Our own refund commitment is set out in our Refund Policy.
9. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
10. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, you may export your appointment data on request within 30 days, after which it may be deleted or anonymised.
11. Liability
To the fullest extent permitted by law, we are not liable for indirect, consequential or special damages, including lost profits, lost data or loss of goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be excluded.
You agree to indemnify us against claims arising from your content, your unlawful use of the Service, or your breach of these terms.
12. General
We may update these terms; material changes will be notified in the app or by email. You may not assign this agreement without our consent; we may assign it in connection with a merger or acquisition. Neither party is liable for delays caused by events beyond reasonable control. These terms are governed by the laws of the State of New York, United States, and the courts of that state have exclusive jurisdiction.
